1. Purpose and scope
The purpose of these General Terms of Service (hereinafter referred to as the "GTS") is to define the terms of use of the website www.marcomoretti.fr (hereinafter "the Site"), as well as the rights and obligations of users (hereinafter "the User") in the context of their browsing, ordering products and accessing the services offered by H and R Agency FZ-LLCa limited liability company registered with the Ras Al Khaimah Economic Zone Authority (RAKEZ) under license number 17005362.
Access to and use of the Site implies full and unreserved acceptance of these GTCS.
2. Acceptance of conditions
By accessing the Site, consulting its content or making a purchase, the User acknowledges that he/she has read the present Terms and Conditions of Sale and declares that he/she accepts them unreservedly.
These conditions may be updated at any time. The current version is the one available on the Site at the time of browsing.
3. Site access and availability
H and R Agency FZ-LLC makes every effort to ensure continuous access to the Site, 24 hours a day, 7 days a week. However, access may be temporarily suspended, without notice, in particular in the event of :
- Technical maintenance
- Content or infrastructure updates
- Malfunction or interruption of a third-party service provider
- Force majeure (see article 7)
The company cannot be held responsible for any unavailability, interruption or malfunction of the Site, whatever the cause.
4. Authorized use - Restrictions
4.1 Personal use only
The products offered for sale are exclusively intended for private and private and personal use. Any unauthorized resale, reproduction or commercial use without the prior written consent of H and R Agency FZ-LLC is strictly forbidden.
4.2 Formal prohibitions
The User is strictly prohibited from :
- Carry out acts of piracy or intrusion into our technical infrastructure
- Impersonate any third party
- Publish comments or content that are defamatory, abusive or contrary to public order
- Use the Site for fraudulent purposes or in violation of applicable laws.
In the event of non-compliance, the company reserves the right to suspend, without notice, the User's access to its services and to take any appropriate legal action.
5. Intellectual property rights
All elements on the Site (texts, images, graphics, logos, trademarks, videos, databases) are the exclusive property of H and R Agency FZ-LLC or are subject to a duly acquired license of use.
Any reproduction, representation, extraction or reuse, even partial, without prior written authorization, is strictly forbidden and constitutes an infringement of intellectual property rights that may give rise to legal proceedings.
6. Liability
6.1 Use of products
The liability of H and R Agency FZ-LLC cannot be held liable in the event of misuse, non-conforming use or negligence on the part of the User concerning the products sold on the Site.
6.2 Limitation of liability
The company shall not be held liable for indirect or consequential damages, in particular:
- Loss of data, loss of opportunity, commercial or moral prejudice
- Delivery delays or interruptions due to circumstances beyond the company's control.
- Technical incompatibility with the User's equipment
- Failures attributable to logistical, technical or financial service providers
7. Force majeure
The responsibility of H and R Agency FZ-LLC shall not be held liable in the event of non-performance or improper performance of a contractual obligation due to an event of force majeure, as defined by applicable case law, and in particular in the event of :
- Natural disaster, fire, storm
- War, riot, attack, embargo
- Total or partial strike by service providers or suppliers
- Network failure, power supply interruption, cyber attack
8. Applicable law and jurisdiction
These General Terms of Service are governed by the laws law in force in the Emirate of Ras Al Khaimah (United Arab Emirates) as well as by the applicable in the free zones of the United Arab Emirates..
Any dispute relating to the interpretation or performance of these TOS shall be submitted to the exclusive jurisdiction of the competent courts of Ras Al Khaimah.
