General Sales Conditions (GSC)

1. Scope of application
These General Terms and Conditions of Sale (hereinafter the "GTCS") govern the contractual relationship between :
- H and R Agency FZ-LLCa limited liability company incorporated in the Ras Al Khaimah Economic Zone (RAKEZ), registered under license number 17005362exclusive operator of the site www.marcomoretti.fr,
and
- Any individual or legal entity (hereinafter referred to as "the Customer") purchasing products marketed on the Site.
The GCS apply, without restriction or reservation, to all sales concluded via the Site and in the territories to which we deliver, in particular:

- 🇬🇧 United Kingdom (Consumer Rights Act 2015)
- 🇺🇸 United States (Federal Trade Commission Act, Magnuson-Moss Warranty Act)
- 🇨🇦 Canada (Consumer Protection Act and PIPEDA)
2. Products - Availability - Presentation
The products offered for sale on the Site are described as accurately as possible. Photographs, texts, illustrations and technical information are provided for information purposes only and have no contractual value.
2.1 Availability
Product offers are valid as long as they are visible on the Site, while stocks last. H and R Agency FZ-LLC reserves the right to modify or withdraw any item at any time without notice.
2.2 In the event of unavailability after ordering
In the event of stock shortage after the order has been validated, the Customer will be informed as soon as possible and will be offered the choice of :
- A reasonable extension for delivery
- A full refund of the amount paid
- exchange at no extra cost for an item of equivalent value
No additional compensation may be claimed.
3. Ordering - Conclusion of contract
3.1 Ordering process
The act of purchasing on the Site follows the following contractual stages:
1. Add to basket Selection of desired items
2. Identification Create a customer account or connect to an existing account.
3. Order validation Confirmation of order: summary of items and acceptance of terms and conditions.
4. Secure payment
5. Order confirmation Acknowledgement of receipt is sent by email
The sale is deemed concluded once payment has been validated.
4. Prices - Terms of payment
4.1 Prices
Prices displayed on the Site are expressed in euros (€)inclusive of all taxes (VAT) for customers located in the European Union or the United Kingdom. Outside these territories, prices are quoted exclusive of tax, and and customs duties or charges may apply (see Shipping Policy).
H and R Agency FZ-LLC reserves the right to modify its prices at any time, without affecting orders already validated.
4.2 Accepted means of payment
Payment for orders may be made by the following methods:
- 💳 Bank cards: Visa, Mastercard, American Express
- 🅿 ️ PayPal
- Other means expressly indicated during the payment process
4.3 Payment security
Transactions are processed via the following platforms Stripe and PayPalplatforms, recognized for their high level of security and PCI-DSS compliance. No banking data is stored by the company.
4.4 Chargeback policy
Any abuse of the chargeback mechanism will be considered as an attempt at fraud. H and R Agency FZ-LLC reserves the right to permanently suspend the customer account concerned and to initiate any appropriate civil or criminal proceedings.
5. Delivery
Delivery terms, zones served, carriers used, deadlines and conditions in the event of late delivery or delivery anomaly are detailed in our Shipping Policywhich is incorporated by reference into these GTS.
6. Right of withdrawal - Returns
In accordance with applicable legislation, the Customer has a period of 14 calendar days from receipt of the products to exercise their right of withdrawal without having to justify the reason.
The terms of return, eligibility, refund or exchange are fully detailed in ourReturns and Refunds Policywhich is also applicable to these terms and conditions.
7. Legal warranties and conformity
7.1 Warranties applicable by territory
The products sold are covered by the legal warranties provided by the texts in force:
- 🇪🇺 European Union Legal warranty of conformity (Directive 1999/44/EC and national transpositions)
- 🇬🇧 United Kingdom Consumer Rights Act 2015
- 🇺🇸 United States Magnuson-Moss Warranty Act
- 🇨🇦 Canada Consumer Protection Act and implied warranties
The customer is covered against any latent defect or lack of conformityunder the conditions provided by the law of his country of residence.
7.2 Limitation
The warranty does not cover :
- Normal wear and tear
- Damage caused by misuse, negligence or improper use.
- Products modified, customized or repaired without prior authorization.
8. Liability
The company H and R Agency FZ-LLC shall not be held liable for any indirect damage, loss of income, immaterial or commercial damage resulting from the use of the products or access to the Site.
Its contractual liability is in any event limited to the amount of the disputed order.
9. Amicable settlement of disputes
In the event of a dispute relating to the performance or interpretation of these GCS, the customer is invited to contact our customer service department as a matter of priority.customer service at contact@marcomoretti.fr in order to seek an amicable solution.
Failing an amicable resolution within 30 days, the customer may have recourse to a consumer mediator (if applicable in his country), or refer the matter to the competent court designated in the following article.
10. Applicable law - Competent jurisdiction
These GTC are governed by the laws law of the Emirate of Ras Al KhaimahUnited Arab Emirates, and the rules of private international lawsubject to mandatory provisions more favorable to the consumer depending on his country of residence.
In the absence of an amicable agreement, disputes will be referred to :
- For individual customers : the courts of the customer's country of residencein accordance with consumer law
- For professional customers : the courts of Ras Al KhaimahUnited Arab Emirates
